OFFICIAL RULES: Sizzle through College, Fissler® Cookware Giveaway Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. The Sizzle through College, Fissler® Cookware Giveaway (the “Giveaway”) is sponsored by Fissler America Inc. (“Sponsor”), 500 Post Road East, 2nd Floor, Suite 201, Westport, Connecticut 06880.
1. Eligibility: The enter the Giveaway you must “Follow the Fissler USA Instagram Page”, “Like the Giveaway Post”, and “Tag a friend in the comments and tell them why you love this cookware set” in response to the Giveaway Instagram Post on the Fissler USA Instagram page at https://www.instagram.com/fisslerusa/. You must also be least 18 years of age or the age of majority in their jurisdiction of residence (whichever is greater) as of the date of entry. The Giveaway is only open to legal residents of the United States and is void where prohibited by law. Employees of the Sponsor, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations.
2. Agreement to Official Rules: By participating, you agree to be fully unconditionally bound by these Official Rules (the “Rules”), and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as they relate to the Giveaway.
3. Giveaway Period: Entries will be accepted online starting on August 22nd, 2023, at 5:00pm EST and ending August 27th, 2023, at 11:59pm EST (the “Giveaway Period”). All online entries must be received by the end of the Giveaway Period. Sponsor’s computer shall be the official clock of the Giveaway.
4. How to Enter: To enter the Giveaway, you must have an Instagram account. If you do not have an Instagram account, you may create one for free by visiting www.instagram.com . By submitting your information and creating an account, you agree to the terms of use and privacy policy of Instagram. If you do not agree to such terms of use and privacy policy, you cannot create an account or participate in this Giveaway. Sponsor may not receive Entries from Instagram users with “private” updates (i.e., Entrant has set his or her account so that only people the Entrant has approved can view his or her updates.) If Entrant is using his or her mobile device to enter, charges, including message and data rates, may apply. Entrants should consult their wireless service provider regarding its pricing plans.
To enter, follow Sponsor’s Instagram account as indicated and respond to the Giveaway offer posted by Sponsor on its Instagram page at https://www.instagram.com/fisslerusa/ then “Like” the promotional post and Tag a friend in the comment section and tell them what you think about the cookware set being promoted; responding in the manner within Giveaway Period. The “Follow”, “Like”, and “Tag a friend with comment” or other required response must include all information required in the post. Limit one (1) entry per unique Instagram account and per person per Giveaway. Entries generated by script, macro or other automated means are void, as are entries that are illegible, garbled, incomplete or that contain errors. Normal time, toll, connection, and usage rates, if any, charged by your Internet service provider will apply. No other entry method will be accepted. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. (1) entry per unique Instagram account and per person per Giveaway. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Entries that are not complete or do not adhere to the Rules or specifications may be disqualified at the sole discretion of Sponsor. You may enter only once. Sponsor is not responsible for lost, late, illegible, misdirected, damaged, or incomplete entries. Entries are property of Sponsor and will not be acknowledged or returned, and no correspondence will be entered into by Sponsor to entrant regarding the status of an entry. You may not enter more than once by using multiple Instagram accounts per person in an attempt to circumvent the Rules. If multiple entries are received from any person or e-mail address, or if you use fraudulent methods or otherwise attempt to circumvent the Rules, your entries will be disqualified at the sole discretion of Sponsor.
5. Prizes: (1) one Winner(s) will receive (1) one Adamant® Comfort Frying Pan & Wok 3-piece set (which includes: 9.5” Frying Pan, 11” Frying Pan and 11” Wok). The approximate retail value (ARV) of each prize is $319.95 and the total ARV of all prizes is $319.95. Actual/appraised value may differ at time of prize award. Difference between actual value and stated value will not be awarded. The specifics of the prize shall be solely determined by the Sponsor. One prize per household/family/person. No cash redemptions or other prize substitution permitted except at Sponsor's discretion. The prize is non-transferable. Any and all prize related expenses including, without limitation, any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner. All prizes will be awarded provided a sufficient number of eligible entries are received. The sponsor has the right to substitute the prize with product that is of equal value.
6. Odds: The odds of winning depend on the number of eligible entries received.
7. Winner selection and notification: Winner of the Giveaway will be selected in a random drawing under the supervision of the Sponsor on or about September 13th, 2023. Winner will be notified via direct message through their Instagram Account used to enter the Giveaway within seven (7) days following the winner selection and selected winner will have (5) days to claim their prize from Sponsor’s 1st notification attempt. Fissler America Inc. shall have no liability for winner's failure to receive notices due to winner's spam, junk e-mail, security settings or other reasons or for winner's provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed affidavit of eligibility and liability and publicity release as required, or if the prize notice is undeliverable, prize may be forfeited, and an alternate winner selected.
The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. Sponsor’s failure or delay to enforce any term of these Official Rules shall not constitute a waiver of that term.
8. Rights Granted by you: By entering this Giveaway or accepting a prize you understand and consent to the right of Fissler America Inc., anyone acting on behalf of Fissler America Inc., or its respective licensees, successors and assigns, except where prohibited by law, without any further notice, review or consent, to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
9. Terms: Sponsor reserves the right, at its sole discretion to cancel, terminate, modify, or suspend the Giveaway should a virus, bugs, non-authorized human intervention, fraud, an Act of God, natural disaster, terrorism, weather, epidemics or pandemics, or other causes beyond its control corrupt or affects the administration, security, fairness, or proper conduct of the Giveaway. In such case, Sponsor will post a notice on the Giveaway Instagram post and may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Official Rules or otherwise abuses the entry process or the operation of the Giveaway or who is acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor is not responsible for any: (a) telephone, computer, hardware, software, satellite, programming or interrupted or unavailable network, server or other connections, network malfunction, or other technical failures or errors, or failure to properly process entries; (b) communication disruption or other forces beyond the reasonable control of the Sponsor, including inability to access the Giveaway web site, submit entries or other disruption related to Internet traffic, virus, bug, or nonauthorized intervention; (c) damage caused by computer virus or otherwise resulting to any computer or mobile device from entrant's access of the Giveaway web site, whether human, mechanical or electronic; or (d) incorrect or inaccurate information whether caused by Giveaway web site users or by any of the programming or equipment associated with or used in the Giveaway.
Sponsor has the right, at its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by the Rules; or the use of bots, macros, or scripts or other technical means for entering. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Notwithstanding the foregoing, Sponsor reserves the right to do anything it choses within the bounds of law to either remedy any situation or discontinue the Giveaway.
Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made; the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. By entering the Giveaway, you agree to receive email newsletters and SMS messages periodically from Sponsor. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter and by reply "STOP" to the SMS.
10. Limitation of Liability: By entering the Giveaway, you agree to release and hold harmless Fissler America Inc. and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error which may occur in the administration of the Giveaway or the processing of entries; and (vi) claims for invasion of privacy, appropriation of likeness or defamation, demands, rights, promises, damages and liabilities brought by whomever and arising out of or in connection with the Giveaway including, without limitation, use or distribution of photographs and/or video recordings. This Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram, and Sponsor and all entrants’ releases Instagram from any liability in connection with this Contest.
11. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF CONNECTICUT WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees that any and all disputes and causes of action arising out of or connected with this Giveaway or any prize awarded which cannot be resolved between the parties, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Connecticut having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.

13. Winner List: To obtain a copy of the winner's name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope addressed to: Sizzle through College, Fissler Cookware Giveaway, Fissler America Inc., 500 Post Road East, 2nd Floor, Suite 201, Westport, Connecticut 06880. Requests must be received no later than September 30th, 2023.
14. Any questions, comments, or complaints regarding the Giveaway should be directed to Sponsor and not to Instagram.
